Welcome to Aspire Alarm. These Terms and Conditions ("Terms") govern your access to and use of the Aspire Alarm mobile application and website at aspirealarm.com (collectively, the "Service"), operated by Aspire Alarm ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using Aspire Alarm, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Description of Service

Aspire Alarm is a mobile alarm application that allows users to wake up to motivational speeches, historical audio, and personal voice recordings. The Service may include free and premium features, which may change over time.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You agree to provide accurate and complete information when creating an account or joining the waitlist.
• You must notify us immediately of any unauthorized use of your account.

5. User Content

Your Recordings: You retain ownership of any audio recordings you create within the app. By using the Service, you grant us a limited license to process your recordings solely for the purpose of providing the alarm functionality.

Restrictions: You agree not to upload, record, or distribute content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, audio, software, and design — are owned by Aspire Alarm or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of our content without prior written consent.

7. Speech Content & Licensing

Motivational speeches and historical audio provided within the app are either licensed, in the public domain, or generated using AI voice synthesis technology. We make reasonable efforts to ensure proper licensing and attribution. If you believe any content infringes your rights, please contact us immediately.

8. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its servers
• Reverse engineer, decompile, or disassemble the application
• Use the Service to transmit spam, malware, or other harmful content
• Impersonate any person or entity, or misrepresent your affiliation
• Use automated systems (bots, scrapers) to access the Service

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee that alarm functions will operate under all device conditions, battery states, or operating system configurations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASPIRE ALARM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Aspire Alarm and its affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Clark County, Nevada.

15. California Residents

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA/CPRA). Please refer to our Privacy Policy for details on how we handle your personal information and how to exercise your rights.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aspire Alarm regarding the use of the Service and supersede all prior agreements.
